When Why Not Bus confirms your booking, a contract is made between you and Why Not Bus under the terms and conditions set out below. In a booking with more than one passenger the ‘lead passenger’ will be deemed to have accepted the terms and conditions on behalf of all passengers within the booking. The ‘lead passenger’ is the passenger who makes the booking on behalf of all passengers in a multi-passenger booking. Within these Booking Conditions, “you” and “your” means all persons named on the booking (including anyone who is added at a later date).

1. BOOKING / ACCEPTANCE

1.1 Why Not Bus accepts a booking on the understanding that a deposit or full payment has been collected and held either by Why Not Bus directly or by an authorised Travel Agent on Why Not Bus’ behalf. Bookings made via Why Not Bus’ own websites are considered as made with Why Not Bus directly.

1.2 On confirmation of your booking, subject to availability and at Why Not Bus’ discretion, Why Not Bus will reserve your place(s) on your selected product(s) “tour(s)”. It is your (or on bookings involving more than one person, the lead passenger’s) responsibility, as the customer, to check the accuracy of your booking including your travel dates.

1.3 In order to reserve your tour:

1.3a) Tours costing 500 AUD or less: full payment must be made at time of booking.

1.3b) Tours costing more than 500 AUD: a non-refundable deposit of 500AUD per person per tour is required, but if the booking is made within 30 days of the nominated departure date the full amount payable must be made at the time of booking. This payment is in addition to any deposit required by your Travel Agent.

Cancellation refunds are as follows;
14 days before travel date – 0% of the fare
30 days before travel date – 30% of the fare
31+ days before travel date – Full fare minus $500 deposit

1.4 Why Not Bus reserves the right to cancel the booking and keep deposit payments if the full payment has not been received within the above specified periods.

1.5 The customer shall comply with all Government (Federal and State) COVID-19 vaccination or testing requirements for entry into Western Australia or to access the tour. Where the customer does not meet a vaccination or testing requirement:
(a) prior to departure from the customer’s home location, the customer will forfeit any and all monies paid; or
(b) for entry on the tour, the customer will not be granted entry and will forfeit any and all monies paid. Where the customer cancels due to travel restrictions other than vaccination or testing requirements, the customer will be contacted and offered a refund or credit note (to be used at a later time), where such an offer is at the absolute discretion of the operator. The operator reserves the right to withhold some monies to cover administrative expenses and other losses, dependent on when notice of cancellation is given by the customer.

2. TRAVELLING

2.1 Baggage is restricted to one reasonable sized backpack and one small carry-on bag per passenger (maximum combined weight 15kg). Carry-on bags must not weigh more than 10kg. Baggage in excess of these limits may not be carried.

2.2 It is your responsibility to check in with the Why Not Bus not less than 15 minutes prior to the specified departure time. As Why Not bus runs on a flexible schedule the arrival dates and times will vary from trip to trip, due to this Why Not Bus will not be liable for any service that departs or returns later than its specified time, even if as a result you miss a connecting service. Why Not Bus will use its best efforts to ensure that departure and return times are met.

3. CANCELLATION & CHANGES

3.1 Cancellation of your booking must be in writing to either Why Not Bus (for direct or website bookings) or the authorised Agent through which your booking was made. If your booking was made through an authorised Agent, all amendments and cancellations must be made directly through the Agent and not with Why Not Bus (the Agent may also levy cancellation charges in addition to those noted below – please check with the Agent at the time of booking).

3.2 Where a deposit has been made on a booking and the said booking is cancelled by you or your authorised Agent prior to full payment being made, or in the circumstances of the balance not being received by the Why Not Bus or their authorised Agent by the due date, no refund of the deposit will be applicable.

4. YOUR RESPONSIBILITIES

4.1 The tour/tour products offered are forms of transportation. For this reason, Why Not bus cannot offer constant special attention or assistance should you have any disability requiring such attention.

4.2 Why Not Bus Trips are backpacking/ camping trips and have been designed for physically fit passengers aged 18 years and over with the style and operation specifically designed for young independent travellers. This fact should be recognised when you book. Passengers are primarily in the 18-35 year age group.

4.3 Passengers must be aged 18 years or over on the date of travel commencing.

4.4 If passengers tests positive for COVID-19 whilst on the tour, said passengers will be required to leave the tour and self isolate for the required duration according to the Government (Federal and State). Passengers who test positive will need to organise their own transport from the location to organised isolation accommodation. No refund will be provided.

4.5 Passengers must adhere to all Government (Federal and State) COVID-19 regulations including the wearing of masks while on the bus and any additional restrictions implemented during the time of tour etc. 

4.6 Passengers with disabilities are welcome on trips, provided that they are accompanied by a companion capable of providing all necessary assistance and do not require special assistance from Why Not Bus personnel. Any medical or physical condition requiring third party attention or treatment must be advised in writing to the Why Not Bus at the time the booking is made. It is your responsibility to see to it that your email is acknowledged. The Why Not Bus cannot guarantee travel in the absence of such an acknowledgement. Similarly, if you wish to make a special request about any matter concerning your travel or accommodation you must do so at the time of booking. Again, it is your responsibility to produce an acknowledgement from our Reservations Team at the time of travel. We will try to accommodate any reasonable requests but we cannot guarantee that your requests will be met. Failure to meet any special requests will not be a breach of contract on the part of the Operator unless the request has been specifically acknowledged and confirmed by Why Not Bus. Why Not Bus reserves the right to refuse to carry anyone if it is felt that the individual cannot cope with the requirements of the tour and who may require services and facilities that Why Not Bus cannot guarantee will be available. The nature of the tours means that not every type of disability can be accommodated despite reasonable endeavours of Why Not Bus. Most tours involve getting on and off busses, sitting for long periods on busses without toilet facilities, walking and other physical activities, which may involve steps and stairs at sightseeing stops, visitor attractions and accommodation units. Buses are not adapted to carry wheelchairs and do not have ramps, lifts or low floor access. The Why Not Bus cannot carry any wheelchairs. You agree not to hold Why Not Bus responsible for any decision made by them or by any service provider to refuse to carry you, provide any facilities or accommodation to you, or to provide any service to you in the absence of written acknowledgement and acceptance of your special request.

4.7 You agree to comply with the authority of the Why Not Bus representative and Australian laws and regulations. If you do not do so, you may, at the discretion of the Why Not Bus representative, be asked to leave the tour. No refunds will be issued in such circumstances.

4.8 You agree that the Why Not Bus’ representatives may take photographs and video recordings of you while you are a passenger. These may be used in the Why Not Bus brochures and/or advertising and publicity material (including social media) without obtaining any further consent or payment in respect of such photographs and/or films.

4.9 You agree that the Why Not Bus may use any text written in comments books, recorded in customer surveys or input to online forums, in brochures, websites and/or advertising and publicity material without obtaining any further consent or payment in respect of comments.

4.10 There may be times when Why Not Bus personnel and/or representatives have to make a decision in the interests of safety. It is a condition of booking that you comply with the authority and decisions of the appointed representative of Why Not Bus. If you do not comply with the said representative or are not compatible with the general enjoyment and well-being of members of the tour, Why Not Bus reserves the right to refuse to allow you to continue the tour. In such a case Why Not Bus will not be liable for any refund, compensation or any additional costs incurred by you. Why Not Bus cannot accept liability for the behaviour of others on your tour nor if any facilities are curtailed as a result of their actions.

4.11 Why Not Bus does not tolerate any form of abuse, verbal or otherwise, of its personnel and other trip members. Any person abusing or threatening Why Not Bus personnel, trip members or associated representatives will automatically forfeit their right to onward travel.

4.12 No liability can be taken by Why Not Bus in case of, but not limited to, damage to personal belongings, personal loss, theft, injury or sickness whilst participating in designated activities including but not limited to bush-walking, snorkelling, swimming, food preparation, cooking, sandboarding, off-road driving or camping. Why Not Bus operates in the outback and remote areas reserve serve the right to alter the route, itinerary or to cancel the operation if road, weather or other conditions dictate. Any personal expenses incurred by a passenger as a result of any curtailment, delay or alteration of any tour, whether caused by flooding, fire, road closure, mechanical defect or any other causes, are the responsibility of the passenger.

4.13 You are responsible for looking after your personal belongings whilst travelling. Why Not Bus cannot be held responsible for any personal belongings left behind, damaged or stolen on any tour irrespective of the circumstances.

5. INSURANCE

5.1 There is no travel insurance cover included in the price of any pass(es), ticket, tour, trip or product provided by Why Not Bus.

5.2 Why Not Bus strongly recommends that you take out comprehensive insurance cover for cancellation, medical expenses, personal accident, personal baggage, money, public liability and COVID 19 changes before you travel. If you choose not to travel with travel insurance please be aware that Why Not Bus or any of its affiliates will take no liability for any cost incurred while travelling with Why Not Bus.

6. CHANGES BY WHY NOT BUS

Why Not Bus reserves the right to vary, modify or cancel any itinerary, either part or wholly. If this is necessary, they will substitute alternative arrangements of comparable value.

7. WEATHER CONDITIONS

Under no circumstances can Why Not Bus be held responsible for any delay, deviation or cancellation due to weather conditions, nor can any tour be cancelled or amended by you at any time on the basis of weather conditions. If any weather conditions require any deviation or changes to the itinerary, Why Not Bus reserves the right to make these changes.
